Should AI-generated inventions be patentable?

The emergence of AI-generated inventions raises crucial questions for the patent system, as traditional norms and frameworks may no longer adequately address the unique challenges posed by inventions created autonomously by machines. This could fundamentally alter innovation dynamics, potentially affecting the incentives for both creating and commercializing new technologies. Given that patent law has historically evolved slowly in response to technological advancements, understanding how to appropriately regulate AI-generated inventions is urgent to maintain the integrity and effectiveness of the patent system.

We explore the normative implications of patenting AI-generated inventions through a theoretical framework and a review of existing literature. We argue for a nuanced understanding of the patent system adapted for AI-generated inventions, considering the implications for commercialization and technology transfer. Our analysis draws from various symposiums and existing empirical studies to evaluate the desirability and practicality of allowing patents on inventions created by AI.

We conclude that while AI-generated inventions present challenges to the current patent system, a stronger case exists for their patentability based on commercialization and technology transfer rationales. Specifically, we argue that without patent protection, the output of AI invention machines risks becoming too challenging to commercialize effectively. We also highlight the potential for increased patent thickets and market concentration, suggesting the need for a re-evaluation of existing patent policy to adapt to the realities of AI-generated innovations and their implications for the innovation ecosystem.
